Protected Disclosures

Staff and students should note that the Whistleblowers Protection Act 2001 has been repealed, and replaced by the Protected Disclosure Act 2012.

As a public body, Victoria University and its employees are subject to the Protected Disclosure Act (PD Act). The purpose of the Act is to encourage and facilitate the making of disclosures of improper conduct by public officers and public bodies.

Improper conduct is defined at length in the PD Act. Very broadly it can be described as conduct by public officers or entities which, if proved, would constitute:

  • an indictable (serious) criminal offence or an attempt to pervert the course of justice, or bribery of a public official; or

  • a criminal offence; or

  • reasonable grounds for termination of employment.


Disclosures which meet the requirements set out in the PD Act are called ?protected disclosures?.

The PD Act also establishes protections from reprisal (detrimental action) for individuals who make protected disclosures and establishes significant confidentiality requirements to protect those individuals.

At present, the view of the Independent Broad-based Anti-corruption Commission (IBAC) is that VU is not an entity which may receive disclosures about improper conduct.

Therefore, anyone wishing to make a disclosure about improper conduct at VU should make that disclosure directly to the IBAC:

Anyone considering making such a disclosure should be aware that VU supports the making of disclosures that reveal improper conduct. VU does not tolerate improper conduct by the organisation, its employees, officers or members, nor the taking of detrimental action in reprisal against those who come forward to disclose such conduct.
